RENTAL AGREEMENT

relating to

2645 3RD AVENUE NORTH, SAINT PETERSBURG, FLORIDA 33713

By placing a booking the Guest agrees to the following terms:

1.CONTENTS
1.1The Guest shall keep the Contents in good and clean condition and shall return the Contents to the Host at the end of the Tenancy in the same state as detailed on the Inventory and Property Condition Report which shall be sent to guests upon booking. The Guest shall confirm to the Host whether or not the Inventory and Property Condition Report is accurate within 24 hours of Check-in. If the Guest fails to confirm to the Host whether or not the Inventory and Property Condition Report is accurate within 24 hours of Check-in the Guest shall be deemed to agree that the Inventory and Property Condition Report is accurate.

1.2The Host and Guest consent to the use of the Inventory and Property Condition Report as evidence in any dispute arising in connection with any Deposit or any other dispute arising with regards to damage to the Property.

2.USE OF PROPERTY

2.1The Guest shall only use the Property as a vacation house, for the use of the Guest and the Guest's immediate family and the Guest’s visitors, if agreed in writing in advance with the Host. The maximum number of guests is limited to 6 persons at any one time.

2.2The Guest shall not use the Property for the purposes of conducting a business.

2.3The Guest shall not keep any pets or any other animals on or in the Property without the prior written consent of the Host.

2.4The Guest shall not do anything to or on the Property that:
(a)causes a nuisance, annoyance or damage to occupiers of neighbouring, adjoining or adjacent property, or the owners or occupiers of them;
(b)involves using the Property for immoral or illegal purposes; or
(c)has the effect of invalidating any insurance that the Host has taken out relating to the Property.

2.5The Guest shall not enter, and shall not attempt to enter, any of the Excluded Areas (being the locked room to the rear of the Property, the attic or the shed).

2.6The Guest shall at all times while at the property and shall cause all members of the rental party and anyone else the Guest permits on the property to abide by the Rental Rules at all times while at the property.

3.ASSIGNMENT OR SUBLETTING

The Guest shall not assign, sublet, part with or share possession of the whole or any part of the Property.

4.REPAIRS AND ALTERATIONS

4.1The Guest shall keep the interior of the Property clean, tidy and in the same condition as at the start of the Tenancy (except for fair wear and tear).

4.2The Guest shall keep the garden clean and tidy, and free from rubbish.

4.3The Guest shall not cause any blockage to the drains, gutters and pipes of the Property.

4.4The Guest shall not make any alteration, addition, or redecoration to the Property.

5.UTILITIES AND OUTGOINGS

5.1The Host shall pay all charges for gas, electricity, water and sewerage services used by the Guest at the Property, subject to fair and reasonable use of the same by the Guest.

6.WAIVER OF LIABILITY AND INDEMNITY

6.1The Guest shall not hold the Host liable for any loss or injury or loss of life suffered by the Guest or the Guest’s visitor howsoever caused (including but not limited to acts of negligence and or gross negligence on the part of the Host) to the full extent permitted by the law.

6.2The Guest shall indemnify and save harmless the Host against any claim for any loss or injury or loss of life suffered by the Guest’s visitor or any others howsoever caused (including but not limited to acts of negligence and or gross negligence on the part of the Host) to the full extent permitted by the law.

7.HOST'S COVENANTS

7.1The Host shall provide the Guest with suitable means of access to and egress from the Property.

7.2The Host shall allow the Guest quiet enjoyment of the Property without any interruption by the Host, subject to clause 9.

8.DEFAULT BY THE GUEST

8.1The Host reserves the right for the Host, or any person acting on behalf of the Host, to re-enter the Property if the Guest has breached the agreement.

8.2If the Host, or any person acting on behalf of the Host, re-enters the Property pursuant to this clause, then the Tenancy shall immediately end. Any right or remedy of the Host in respect of any breach of the terms of this agreement by the Guest will remain in force.

8.3If the Guest breaches this agreement or fails to fulfil any of its obligations under this agreement, the Guest shall pay any reasonable costs properly incurred by the Host in remedying such breaches or in connection with the enforcement of those obligations.

9.HOST'S RIGHT TO ENTER THE PROPERTY

9.1The Host reserves the right for the Host, or any person acting on behalf of the Host, to enter the Property on giving at least 24 hours' prior notice in writing (except in the case of emergency, in which case no notice shall be given) to the Guest:
(a)to inspect the condition and state of repair of the Property;
(b)to carry out the Host's obligations under this agreement;
(c)to take gas, electricity or water meter readings;
(d)for any purpose mentioned in this Tenancy or connected with the Host’s interest in the Property or any other property.

10.EXPIRY OF THE TENANCY

10.1At the end of the fixed term granted by this Tenancy, the Guest shall return the Property and the Contents to the Host in the condition required by this agreement.

10.2If the Host agrees in writing for the Guest to remain in the Property after the Term has expired then the Tenancy shall continue on a nightly basis at a rate of $150 per night, or such other sum as agreed in writing by both parties.

10.3The Host has the right to recover possession of the Property if the Term has expired.

10.4The Guest shall remove all personal possessions from the Property once the Tenancy has ended. If any of the Guest's personal possessions are left at the Property after the Tenancy has ended, the Guest will be responsible for meeting all reasonable removal and storage charges. The Host will remove and store the possessions for a maximum of one week. The Host will take reasonable steps to notify the Guest at the last known address. If the items are not collected within one week, the Host may dispose of the items and the Guest will be liable for the reasonable costs of disposal. The costs of removal, storage and disposal may be deducted from any sale proceeds.

11.NOTICES

11.1Any notice to the Host sent under or in connection with this agreement shall be deemed to have been properly served if sent to the Host via the Airbnb messaging system.

11.2Any notice sent to the Guest under or in connection with this agreement shall be deemed to have been properly served if:
(a)sent by first class post to the Property;
(b)left at the Property; or
(c)sent by the Airbnb messaging system.

12.GOVERNING LAW
This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of the State of Florida.

Exhibit A

RENTAL RULES

1.Smoking is NOT allowed.
2.Guests should not create excessive noise at a level that disturbs neighbors. Quiet hours are from 11:00p.m. – 7:00a.m.
3.Keep the property and all furnishings in good order
4.Only use appliances for their intended uses
5.Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units.
6.Garbage: Any garbage must be stowed in the proper garbage or recycling receptacle, located at the alley behind the house.
7.Fireplace: The fireplace is not in working order. Please do not attempt to operate the fireplace. Attempting to operate the fireplace would be a serious fire risk.

The space
The rental includes a master bedroom (with walk in closet and en suit), two standard bedrooms one with a queen size bed and one with a king which can be converted to two twin beds, and a queen sized inflatable airbed in the separate office. If you have an infant there is also a travel crib available.

There are two lounges, both with large flat-screen TVs, DVD players, basic cable and internet TV connectivity via Roku. There is also TV with Roku in the master bedroom.

Neighborhood overview
Built in 1922 with original wood floors, the house has been recently remodelled to a high standard while keeping the charm for which the neighbourhood is known. The neighbourhood is one of the most desirable in St Pete - historic, artistic, green and beautiful. We are within walking distance to some of the best restaurants bars and breweries the city has to offer, but feel like our own tranquil little spot away from it all.
Getting around
Getting around St Pete is easy. The bayshore is to our east, the Gulf of Mexico to our west, so we are perfectly located for both. There are bike rentals available around the corner from us, so cycling to nearby sites and locations is easy but many are also within easy walking distance.
